By accessing or using Zenith ("the Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the Service. Zenith reserves the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Description of Service
Zenith provides a unified search intelligence platform combining Web SEO and App Store Optimization (ASO) tools. The Service includes keyword tracking, site audits, app audits, competitor analysis, AI-powered insights, and reporting functionalities. Features and availability may vary based on your subscription plan.
3. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Use License
Zenith grants you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not: (a) modify, copy, or distribute the Service; (b) use the Service for any unlawful purpose; (c) attempt to reverse engineer or extract source code; (d) use automated tools to scrape or harvest data beyond normal API usage; (e) resell access to the Service without written authorization.
5. Subscription and Billing
Paid plans are billed on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice. Downgrading your plan may result in loss of features or data associated with higher-tier plans.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of all data you submit to Zenith. We process your data solely to provide and improve the Service. Aggregated, anonymized data may be used for analytics and product improvement.
7. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Zenith and is protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used in connection with any product or service without prior written consent.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. SEO and ASO recommendations are based on algorithmic analysis and do not guarantee specific search rankings or app store positions. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
9. Limitation of Liability
To the maximum extent permitted by law, Zenith shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
10. Termination
We may terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service will cease immediately.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Zenith operates, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration.
